License Suspension and Work Permits for DUI or Traffic Offenses

There are two parts to an arrest for drunk driving: the criminal court case and an administrative license suspension hearing. These proceedings are separate. It is possible to win your suspension hearing even if you are convicted of DUI. (It is also possible to lose your license even if you beat the DUI charges.)

Experienced lawyer Daniel P. Weiner handles both aspects of DUI defense. He can defend you on DUI (DWI) charges and fight for you in your Department of Motor Vehicles administrative per se hearing to retain your license or obtain a work permit. Our clients include underage drivers and CDL truck drivers facing stiff license sanctions.

The Law Offices of Daniel P. Weiner serves Stamford, Greenwich, Darien, Bridgeport and surrounding communities of Fairfield County. Contact us to set up a free consultation.

Drivers License Penalties for DUI in Connecticut

The period of license suspension for driving under the influence (DUI) depends on blood-alcohol content (BAC), prior offenses, age and type of license.

  • A first-time DUI (.08 BAC) carries a 90-day license suspension, or 120 days for BAC of .16 or higher.
  • Drivers under 21 are subject to 180-day suspension at .02 BAC.
  • Refusal of a Breathalyzer test is an automatic 180-day suspension.
  • Driving with a suspended license (DUI-related) is a serious misdemeanor crime punishable by up to one year in jail (30 days of which cannot be suspended absent mitigating circumstances), plus additional license suspension/revocation.

The license sanctions for repeat offenders rise sharply: nine months to a year for a second DUI or refusal, and revocation for two to three years for a third drunk driving conviction or refusal.

CDL and DUI — Commercial drivers can be charged with DUI for a BAC of only .04, even if driving a personal vehicle at the time of arrest. The DMV can disqualify a commercial driver's license (CDL) for life, even on a first offense, for operating a commercial vehicle while under the influence. Mr. Weiner understands that your livelihood is at stake. He will use every strategy to fight the criminal charges and especially the CDL revocation.

DMV License Hearings and Work Permits

Your license will be automatically suspended if you do not request a DMV hearing within seven days of the DUI arrest. At the hearing, attorney Weiner can cross-examine the arresting officer and challenge the basis for suspension, including errors or rights violations in the arrest.

Mr. Weiner has had success litigating these cases, but often the suspension will be upheld. At no additional cost, he will help you qualify for a work permit or school permit that allows you to drive to and from a job or accredited academic institution.
